Graphic Design & Print – Full Terms & Conditions

In these Conditions “Hatchit”, “Hatchit Design” or “Hatchit (London) LTD” refers to “The Company”

“Print” or “Contract Work” shall mean any goods or services supplied by Hatchit (London) LTD,

“Print”, “Quotation” or “Contract” shall mean the documented description of Contract Work,

“You” or “The Customer” shall mean any person or business to whom any quotation of Hatchit (London) LTD is addressed or who enters into a Contract for the supply by Hatchit (London) LTD of Contract Works;

the expression “liability whatsoever” shall include, without prejudice to the generality of the expression, liability in tort and in contract, including liability for death, personal injury, damage to, or loss of, property and all direct, indirect and consequential loss of any kind, however caused or arising but excluding any liability for death or personal injury resulting from Hatchit (London) LTD’s negligence within the meaning of the Unfair Contract Terms Act 1977.

These Conditions shall apply to all orders accepted by Hatchit (London) LTD who only does business thereon.

Any exclusion or variation or attempted exclusion or variation of these Conditions by the customer shall be ineffective unless expressly agreed to in writing by an authorised representative of Hatchit (London) LTD.

The giving by the customer of any instruction for the delivery of goods or for the carrying out of work or any conduct by the customer in confirmation of any quotation purporting to incorporate these Conditions shall constitute unqualified acceptance by the customer of these Conditions.

All quotations are made and all orders accepted subject to the following conditions. All other conditions whatsoever are excluded from the Contract and any variation thereof unless expressly accepted by Hatchit (London) LTD in writing.

A quotation is not an offer, and no Contract shall come into existence unless and until we have accepted in writing your official order to carry out Contract Work, specified in the quotation, or payment of deposit or full invoice to proceed with the design and/or print.

Quotations are only valid when supplied by Hatchit (London) LTD or Hatchit (London) LTD.

Design Information

Whilst your finished printed material will be printed to match your artwork, Hatchit (London) LTD will not be held liable for any colour deviation due to the widely varying results from different output devices including inkjet and laser printers, continuous tone proofing devices, high-resolution film-based proofs and different than true offset lithography. Please remember that from one commercial printing firm to another there can be significant differences in results.

There should be 3mm bleed around the finished artwork.

The artwork should be in Press ready PDF (font embedded) format in CMYK with minimum 300dpi resolution. We process only in CMYK format. If there are any Spot colours in the artwork, it will be converted to CMYK. We cannot take responsibility for colour reproduction of RGB files.

Our Standard Business Card size is 85mm x 55mm. All business cards other than this size will be scaled to 85mm x 55mm. If you still require a non-standard size, please email info@hatchitdesign.com. We don’t proof Business cards – the supplied artwork will go straight to print without pre-print checks so please ensure your artwork is designed correctly for print.

SPOT UV turnaround times are an estimate only.

For oversized folders we recommend that the print is laminated if there is a solid image to reduce the possibility of cracks developing on the spine. Hatchit (London) LTD will not be held liable for cracking along the spine.

The orientation of booklets is portrait. If require a landscape booklet please call us for a price. All PDF’s should be single page and not created as spreads with registration/printers marks (trims).

Delivery Of Your Print

We only use reputable courier companies to deliver your print. We cannot be held liable for late delivery or damage in transit – in the event of damage please contact the courier company directly.

Delivery schedules are indicative only.

Time for delivery is given as accurately as possible but is not guaranteed. If you choose to cancel your order due to non-delivery please be aware that you will not be entitled to any refund.

Date of delivery shall be dependent upon receipt of final instructions or approval of proofs being obtained from the customer.

The suggested delivery time starts from the date of approval and ends at the date of dispatch to our couriers for delivery.

Hatchit (London) LTD will endeavour to comply with any reasonable request by the customer for postponement of delivery but shall be under no obligation to do so and the customer will be obliged to take delivery as stated initially.

Where postponement is agreed by Hatchit (London) LTD in writing, the customer shall pay all costs and expenses incurred up to the date of postponement including a reasonable charge if applicable for storage of their finished, printed materials – we will confirm any storage charges.

If you have any complaints about any damage or missing print (shortage) it should be reported to us within 24 hours of delivery. Any claims after this period will be rejected. Once a shortage is agreed on your print with Hatchit (London) LTD, the shortage may be reimbursed on a pro-rata basis.

You will be emailed with an estimated delivery date when your print is dispatched from our warehouse. We offer free delivery on the first delivery attempt only. If the courier is unable to deliver your print and it is sent back to us, you will be charged the cost of all subsequent re-delivery attempts.

The proof of delivery docket must be signed as “damaged product” if it is damaged and you must refuse the print at the time of delivery. If you do not do this then we cannot make a claim which means you will not get a reprint or refund of your print.

A variation of up to plus or minus 10% of the quantity ordered may occur.

Responsibility of the print will pass to the customer immediately on delivery of the goods. Before this stage, responsibility lies with the courier company.

Making Payment & Cancellation

UK VAT at the standard rate will be added to the price of the print where UK VAT is applicable. Comprehensive details on VAT regulations can be found on the HM Revenue & Customs website.

Cancellation of prepaid orders will still incur charges where no fault exists on the part of Hatchit (London) LTD. In the event of an agreed refund, you will be refunded less a 50% fee which is levied on Hatchit (London) LTD on placement of the order.

If the print has been approved & subsequently cancelled, it may have been already been setup, ready for print prior to your cancellation. Hatchit (London) LTD will not be able to cancel the print once it has been sent to print and therefore no refund can be given.

We do not offer credit and all print orders must be paid in full, either by Cheque, BACS or funds transfer before your order is printed. Please be aware that Cheques will be subject to full clearance before your order is processed.

Prices & Quotations

 All prices quoted shall be valid for 30 days from the date of the quotation. Should you choose to print after this period, we will need to re-quote.

All prices quoted are subject to fluctuation in the cost of labour, materials, overheads and transport and any increase in such costs during the period of production.

Corrections, laser proofs and program amendments will be chargeable unless otherwise stated in writing.

Preliminary Work & Copy

A charge may be made to cover any additional work involved where the copy supplied is not clear and legible.

All work carried out either experimentally or otherwise at the customer’s request will be chargeable.

Proofing Your Artwork

It is the sole responsibility of the customer to check all details on any ‘Proofs’ supplied. Errors or omissions are the sole responsibility of the customer and Hatchit (London) LTD will be under no liability whatsoever and will proceed with printing once the customer has approved the ‘Proofs’. In some instances we will not send out proofs.

If artwork is supplied by the customer we will send this straight to print without pre-print checks (Proofing). In this instance Hatchit (London) LTD will assume that the customer has thoroughly checked the artwork before sending to us. Hatchit (London) LTD will not be held liable for any errors or omissions in artwork supplied by the customer and the customer will not be entitled to a reprint or refund.

If Hatchit (London) LTD creates the artwork, we will require you to fully proof the artwork before sending it to print.

Should the customer cancel prior to fulfilment of the contract, the customer shall pay all costs and expenses incurred up to the date of cancellation.

When style, type or layout is left to Hatchit (London) LTD judgement, changes made by the customer will be liable to additional charges.

Illegal Content

Hatchit (London) LTD will not print any artwork that may be of an illegal or libellous nature or an infringement of copyright or other rights of any third party.

Hatchit (London) LTD shall be indemnified by the customer in respect of any claims, costs and expenses arising out of any libellous content or any infringement of copyright, patent, design or any other proprietary or personal rights contained in any material printed. Indemnity shall extend to any amounts paid on a lawyer’s advice in settlement of any claim.

Sub-Contractors

Hatchit (London) LTD shall be entitled to appoint one or more sub-contractors to carry out all or any of Hatchit (London) LTD obligations under this contract.

Machine Readable Codes

In the case of machine readable codes or symbols, Hatchit (London) LTD shall print the same as specified or approved by the customer in accordance with generally accepted standards and procedures.

The customer shall be responsible for ensuring that the codes or symbols will read / scan correctly on the equipment likely to be used.

Hatchit (London) LTD will not be held liable for any errors resulting from codes or symbols not reading/scanning correctly.

Force Majeure

Hatchit (London) LTD shall be under no liability for any delay, loss or damage caused wholly or in part by any act of God or by any act done or not done pursuant to a trade dispute whether such dispute involves Hatchit (London) LTD or not.

Legal

The Contract shall be governed and interpreted exclusively according to the law of England.

Retention Of Title

The property in any goods supplied by Hatchit (London) LTD shall remain in and with Hatchit (London) LTD until the customer has paid in full all amounts due to Hatchit (London) LTD.

Breach Of Contract

In the event of any breach by the customer of the obligations set out in these conditions or otherwise imposed on the customer by any contract with Hatchit (London) LTD, then, without prejudice to any other claim on the part of Hatchit (London) LTD, the customer will pay Hatchit (London) LTD at normal rates for all time wasted as a result of such breach.

Confidentiality

Neither party shall either, during the term of a contract or provision of service under these Terms and Conditions or thereafter, disclose to any person the content of such contract or any information concerning the business of the other party acquired (whether during the term of such contract or in any negotiation leading to its signature) by any means or in any way connected with provisions of the service. This obligation shall not apply:

  • To information which is public knowledge.
  • To information the disclosure of which is essential to the provision of service and performance of such contract.

Copyright

Any specification or particulars submitted to the customer in response to any request for quotation or otherwise shall remain the property of Hatchit (London) LTD as shall the copyright therein and shall be returned to Hatchit (London) LTD at the conclusion of the contract or earlier demand.

No such drawing specification or particulars shall be disclosed to any third person except with written permission from Hatchit (London) LTD.

Hatchit (London) LTD reserves the right to charge the customer the full price for any draft layout, proof, design, drawing or any other visual representation whether computerised or printed.
